The International Trade Administration Commission has published the essential facts letter on the wheelbarrow sunset review investigation. An essential facts letter is part of the anti-dumping investigation process. The letter informs all interested parties of the essential facts under consideration. Furthermore, it forms the basis of the final decision ITAC intends to make.
Anti-dumping duty to increase
The anti-dumping duties on wheelbarrows imported from China are set to increase dramatically. ITAC calculated a dumping margin of 2596.14%. This is massive. The dumping margin is the difference between the domestic price (price in China in this case) and the export price, expressed as a percentage of the export price.
Based on this dumping margin, ITAC intends to increase the anti-dumping duty from 3720c per kg to 103 736c per kg.
Effects of not cooperating in anti-dumping investigations
No Chinese manufacturers or local importers participated in the sunset review investigation. ITAC only relied on information provided by the local manufacturer. This is a good case demonstrating the consequences of not participating in anti-dumping investigations.
When an exporter participates by making submissions to ITAC, dumping margins for the specific exporter are calculated based on their own set of information. If no dumping is found no anti-dumping duty is imposed. If there is some level of dumping the duty eventually imposed is based on the foreign manufacturer’s information.
